LIVE-OUT AND LIVE-IN NANNY EMPLOYMENT AGREEMENT

This agreement is between the live-in or, live-out nanny /care-giver/employee, and, the parents/single parent/legal guardian/family/employer. The term children apply to a child, a baby, twins, multiple infants and young children. The terms she/her/he/him apply to either gender.

During the life of this agreement, the parties involved can formally evaluate and discuss new conditions of employment as they arise and as often as they consider necessary amend.

This agreement will automatically renew the day after its expiration providing the nanny continues working for the employer, and, providing that no amendments are required. 

General Information

The following constitutes an employment agreement between [employer], the employers, and [employee], the nanny.

The nanny will not do any work for any other person not named herein.

The renewal of this contract will be discussed between fifteen to thirty days prior it’s end.

Family relocation

Employer will communicate to the nanny three months in advance or sooner, their intentions to move to a new residential zone that will become the temporary or the permanent working place for the nanny. Relocating will require modification of this contract to accommodate the new commute, new duties for the nanny, schedule modifications and salary. In such an event of changing the nanny’s employment’s place, the nanny will be offered in advance the choice to find new employment.

Nanny Responsibilities 

The employers’ children will be under the care and sole responsibility of the nanny while parents are away.

Nanny will provide the necessary forms for family emergency contacts, authorization to act in case of an emergency and authorization to treat a minor, that she is required to have, with the pertinent updated information clearly visible on the wall, refrigerator, etcetera, as well as in the nanny’s possession always during her shift. 

Families with babies, the nanny will write a daily log with baby’s meals, diaper change, etcetera, to confer with parents about any issues as they occur, as well as keeping the parents informed in regards to their infant’s milestones promoting efficient communication with parents in a day-by-day basis.

Nanny will be responsible for the care of [Child].

Any addition to the family will be a significant change in the routine of the nanny (see compensation). 

Nanny is expected to perform, in an ethical manner, all her nanny duties when parents are away.

It is the nanny’s duty to make sure she does her duties even when employers are at home.

Nanny shall closely adhere to the form of parents’ family dynamics and philosophy preferences.

Nanny might use her phone during her breaks or children’s naps without leaving her main chores undone.

Nanny is not to bring visitors to her workplace without approval of her employers.

The use of the nanny’s cellular phone while on the job shall be used to communicate with parents the job-related events and emergencies, and other matters that apply to the job i.ie. children’s and household online purchasing, children’s appointments and activities, and work related online re-search. Nanny is to maintain a cheerful and helpful attitude with the children

Nanny is to promote feelings of security to children and will provide a warm daily environment, as well as to plan age appropriate and fun activities.

Nanny’s primary duties are to ensure that the safety, health, education, development and wellbeing of the children are never jeopardized.

The number one priority to the nanny is to always keep the children safe.

Nanny will treat the children in her care with kindness and respect making possible to protect the children’s integrity at all moments 

Especial Considerations

The use of the nanny’s personal cellular phone while on the job will be limited to the nanny’s occasional emergency and important personal, home and family matters. The nanny shall use her phone to pay her utility bills, update her credentials i.e. CPR card, or, to read while taking a break.

Household duties 

  1. Nanny will leave the home in the same or better condition than it was when arriving at work, exempt from special provisions or circumstances.
  2. Nanny will do the children’s laundry, fold, sort, mend and iron as needed.
  3. Nanny will keep an inventory of formula, milk, diapers, wipes, diaper rash cream, shampoo, lotion and medications and will inform the parent’s when such necessary items are running low.
  4. Nanny will Keep the children’s room and all the common working areas tidy and picked up.
  5. Nanny will prepare children’s meals and will clean after the children’s meals.

Hygiene

  1. Nanny is to wash her hands before every feeding and, before/after each diaper change, and, as often as necessary.
  2. Children plates, cups, bottles and utensils are not to be used by the nanny or other children at the same time.
  3. Nanny is to ensure that no other person besides parents and siblings are allowed to kiss children on the mouth.

It is unacceptable for the nanny to drive recklessly, and especially while the children are in the car.

 Employer’s Responsibilities

All adults in the house are responsible for setting limits in regards to what counts for inappropriate children’s behavior, using methods that preserve the children’s dignity and integrity.

Employers authorize the nanny, based on their experience and expertise, to implement positive child-rearing methods that ensure the child's safety, dignity, and well-being, both in the family's presence and absence.

It is the employers’ responsibility to hire other home professionals to perform services i.e. installations, lawn and gardening, nanny-manual- car wash, back and front tall window cleaning, deep house cleaning, pet care.

Compensation

Nanny wages will be paid weekly, on each Friday.

Nanny gross wages will be $ 35/hr.

A salary review will take place 6 months from the date of employment and 1 year thereafter based on nanny’s performance and other changes altering the description of the job.

In the event that an additional child requires care, the hourly rate will increase by $5.00 per child per hour.

Employers agree to deduct all required taxes from every paycheck, i.e. Social Security, Medicare and Withholdings, and will provide the nanny with a W-2 form at the beginning of each calendar year.

Employers will compensate their nanny her normal wages during the following event:

  1. When the family leaves in which event the nanny services are not required. However, employers might substitute children related work like organization of children’s closets, children’s rooms and play-areas during the days the entire family will be absent.

Overtime and overnight work

Overtime will be subject to the approval and pay of the employer. 

 

Overtime hours of work shall be compensated by the employers the same day.

Overnight hours will be compensated at the end of each overnight shift.

Overtime and working on paid holidays and Sundays will be paid at a 1.5 the nanny’s normal rate. An exception to this will be when Sunday is the first working calendar day of the nanny. 

The nanny overtime pay is $52.50

The nanny agrees to work overnights when pre-arranged based on her availability.

Overnight fees begin at the normal bed-time of the child and ends 8 hours after that.

Live-in or live-out nanny overnight rate is $36.00 per hour.

Live-in nanny uninterrupted 8 hour of straight night-sleep AND in the nanny-room is not considered overnight work.

Live-in nanny uninterrupted 8 hour of straight night-sleep when the nanny sleeps in the child’s room it is considered overnight work. 

Any hours worked beyond an 8-hour shift will be compensated as overtime when the nanny's regular workweek consists of 40 hours. If the nanny has agreed to a reduced schedule of 30 or 35 hours per week, overtime will be calculated only after reaching 40 hours of work.

Paid time-off

 Employers agree to pay for outings, passes, meals and other child related expenses for nanny and children while in nanny care.

Nanny agrees to provide receipts for all the employer’s approved expenses using the cash or the employer’s credit card.

Nanny is not allowed to use the employers’ cash or credit card for personal purposes without previous writing authorization of her employer.

 Nanny agrees to show receipts for transactions authorized by the employer paid accidentally out of her pocket, authorized by the employer for reimbursement.

Employer agrees to reimburse the nanny for authorized transactions made out-of-the-nanny’s-pocket, timely, and no later than the nanny’s following pay day.

Nanny Background and Monitoring 

The nanny agrees that she might be subjected to random background checks by her employer. The fees associated with such background-checks will be covered by the employer.

Employee will promptly inform the employer of any tickets, arrests, misdemeanors or felonies facing while her placement and throughout the duration of the placement.

Nanny agrees that her employment place might be equipped with live and recorded security-surveillance and monitoring equipment.

Employer agrees not to use monitoring cameras on the nanny private areas like bedrooms and bathrooms. The only exception will be, the nanny, or the employer carrying a baby mobile monitor with them all around the working place while the nanny is on duty.

Evaluation

Employer agrees to provide the nanny with at least one annually written performance-evaluation.

Employer agrees to openly and promptly discuss their nanny’s concerns in regards to any issue that might be affecting her performance at the workplace.

Employers agree to openly and promptly communicate to the nanny any concern in regards to the nanny’s performance at the workplace, to confer viable methods of improvement for the job.

Employer agrees to listen to the nanny’s concerns at the workplace and will provide follow-up feedback. 

Family friends and visitors

The parents agree to respect the nanny’s’ working routines during family and friends’ visitations.

Other family members and friends visiting with small children will be responsible for the care of their children.

Taking care of children of family and friends visiting will constitute extra work for the nanny, and shall be compensated at the nanny’s-regular-rate per child in addition to her normal rate.

In case of a natural disaster, the nanny is required to safely guard every child in her care. In the case that the nanny is not humanly able to save everyone before help arrives, the nanny is required to save ___ the family’s children first ___ the children of the family’s friends or family members first.

Termination of agreement

___ Employer will hand a written verification of employment letter containing the duration of the nanny services and the duties of the nanny.

Employer will let the nanny go with a letter of recommendation containing the nanny’s relevant information i.e. strong demeanors, skills and work-related performance during her placement.

Employer and employee agree to make all efforts in good-faith to promptly, formally and diligently discuss any conflicts that might arise at the workplace. As a back-up measure, both parties agree to seek professional advice to bring the employment back to common grounds.

Either party may terminate this agreement for any unethical reason within ______ days’ notice.

After separation, any reimbursements i.e. the nanny relocation, authorized transactions and any other outstanding pay owed to the nanny will be paid by the employer in a time no later than her final pay. 

Employer will terminate this contract without pay or warning for one of the following offenses:

___ nanny taking illegal drugs.

___ nanny drinking alcohol at work.

___ nanny harsh treatment or excessive discipline on the children.

___ nanny brings unapproved guests to work

Employers can terminate this agreement with two weeks’ notice.  The employer will pay the nanny her normal pay, in addition to any reimbursements owed to the nanny, plus any pay-time-off owed to the nanny and the benefit of two-week severance pay along to any other benefit the employer might want to offer the nanny upon termination.

If employer decides to keep the nanny working the two weeks after given notice, or, if the employer decides not to keep the nanny working such two weeks, the employer will pay the nanny her normal pay, in addition to any reimbursements owed to the nanny, plus any pay-time-off owed to the nanny and the benefit of two-week severance pay along to any other benefit the employer might want to offer the nanny upon termination.

The nanny will reimburse the employer any amounts owed to the employer, or, the employer might want to deduct from the nanny’s final pay-check all the amounts owed by the nanny.

This agreement can be terminated by the nanny for due cause as employer’s breach of contract, or, the nanny’s total or partial disability, or, for any reason or illness and for the inability of the nanny to perform her duties for a period exceeding ___ consecutive weeks, and, with two weeks of termination notice to the employer, and, with paid-work at the nanny’s normal rate in addition to all amounts owed to the nanny, 

Confidentiality

From the starting day and ever after, all confidential data, videos or photos, being such of a personal or business nature, written or verbal, pertaining to the employers or their family members will remain private. The employee agrees not to reproduce, release, share or disclose in any platform or social media, or, to give permission to any other person to conduct such without the previous written authorization of the employers. 

Employer agrees not to reproduce the nanny’s confidential information, nor to release, share or disclose personal information, video and photos of the nanny in any platform or social media.

Any property and confidential files pertaining to the nanny will be handed to the nanny at the time of separation or, mail to the address on file. If the nanny files are not timely handed or mailed to the address on file, the employer agrees to properly destroy such files before disposing of them.

All the personal information pertained to the nanny will exclusively be disclosed only with the authorization of the nanny for future employment opportunities and Government.
